I UNDERSTAND THAT I MAY BE PLAYING SOFTBALL WITH THOSE WHO ARE or WILL TURN 55 AT ANY POINT FROM TODAY THROUGH DECEMBER 31, 2024
WAIVER & RELEASE
Physical exercise can be strenuous and subject of serious injury. The Jupiter Senior Softball Association (JSSA) urges all individuals to obtain a physical examination from a doctor before participating in any JSSA activities.
I voluntarily, and of my own free will, elect to participate in JSSA activities. I understand that there are certain risks involved in participation that may result in injury as a result of weather, playing conditions, equipment and other participants. I agree that if I engage in a physical exercise or activity, I do so entirely at my own risk. I agree that I am voluntarily participating in these activities and assume all risk of injury, illness, or death. I am in good health and have no physical conditions that would prevent me from participating in JSSA activities.
I acknowledge that I have carefully read this Waiver and Release and fully understand that it is a release of liability. I expressly agree to release and hold harmless JSSA, including members of the Association, Directors, Managers, Players, Sponsors, the Town of Jupiter or its employees from any and all liability for any harm, personal injury, property damage, illness, including but not limited to COVID-19, or other damage resulting from participation in JSSA activities, including all risk, whether foreseen or unforeseen.
I will indemnify and hold harmless JSSA, including members of the Association, Directors, Managers, Players, Sponsors, the Town of Jupiter or its employees from any loss or liability including but not limited to bodily injuries, illness, death, and/or for damage to property, including the loss of use thereof, which results or is alleged to have resulted from my participation in JSSA activities.
To the extent that statute or case law does not prohibit release of negligence, this release shall include, but not be limited to, a claim for negligence, fault, neglect, or otherwise of JSSA. This release is binding upon me, my heirs, executors, administrators, and assigns.
If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.
By signing this release, I acknowledge and I understand its content and that this release cannot be modified orally.
JSSA CODE OF CONDUCT
The objective of this Code is to promote and ensure high standards of behavior in all interactions among JSSA members. While it defines unacceptable activities and resultant sanctions, it is meant to promote a pleasant environment for everyone to enjoy the game we love with the camaraderie of good friends.
THE FOLLOWING ACTIVITIES ARE CONSIDERED UNACCEPTABLE AND SUBJECT TO DISCIPLINARY ACTION:
A. Any language or gestures toward another JSSA member, umpire or spectator intended to harass, humiliate, threaten or cause embarrassment.
B. Any statements that are bigoted, hateful, racially offensive or intended to intimidate.
C. Any excessive use of language that is vulgar, obscene or profane.
D. Any confrontation of a physical nature including but not limited to: verbal threats, shoving, hitting, throwing at or using any object that could cause harm and intentional collisions.
E. Arguing with an umpire or another player. All on field discussions regarding calls should be between umpires and team managers. All umpire calls are final.
F. The use of an illegal bat.
G. Any member participation while under the influence of alcohol or illegal controlled substances.
H. Any conduct that could be considered unsportsmanlike or detrimental to the interest of the Association.
I. Any verbal confrontation between members that is determined NOT to be ?good-natured banter? which adds to the fun enjoyment of the game.
GUIDELINES AND ACTIONS
A. These guidelines will apply to all JSSA members.
B. Enforcement of this code can result in disciplinary action ranging from verbal warnings to league expulsions as determined by the JSSA Board of Directors. JSSA Board members and authorized JSSA umpires may issue game ejections and verbal warnings.
THE APPEAL PROCESS
A. All appeal requests must be submitted in writing WITHIN 24 HOURS OF THE ENFORCEMENT ACTION NOTIFICATION. An appeal request does not stay an enforcement action. The request will be reviewed within a reasonable timeframe by the Executive Committee which will uphold, modify or overturn the enforcement action.
