MINOR RELEASE OF LIABILITY AND HOLD HARMLESS FORM

I/We fully understand that:

(a) There are risks and dangers associated with participation in sports activities, including but not limited to those of bodily injury, partial and/or total disability, paralysis and death;

(b) The social and economic losses and/or damages, which could result from those risks and dangers described above could be severe;

(c) These risks and dangers may be caused by the negligence of the participant or the negligence of others, including, but not limited to, the Releases named below;

I/We accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of Releasees named below.

I/We HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE METRO ALL-STARS, Its members, clubs, event hosts, other participants, coaches, instructors, officials, sponsors, advertisers, owners and leasees of the premises used to conduct the event and each of them, their officers, directors, agents and employees, all of which are referred to as Releasees, from all liability to; the undersigned, my/our personal and all claims, demands, losses, or damages on account of any injury, including but not limited to the death of the participant of damage to property, caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.

On behalf of the participant: and individually, the undersigned parent(s) and/or legal guardian(s) for the minor participant executes this Waiver and Release if, despite this release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal guardian(s) will reimburse the Releasees and their insuring company for any money which they have paid to the participant, or on his/her behalf, and hold them harmless.

I/We agree that this Waiver and Release Agreement covers each and every event sponsored by the Metro All-Stars and fully understand that the Releasees are released as to each and every activity and event.

METRO ALL-STARS: AAU CLUB SUPPLEMENTAL WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19

ASSUMPTION OF RISK, WAIVER OF LIABILITY, and INDEMNIFICATION AGREEMENT

In consideration of being allowed to participate on behalf of the Metro All-Stars AAU Club athletic programs and related team practices, club and team events including tryouts, outdoor workouts, competitions such as games, league and tournaments, training sessions, and other related Metro All-Stars AAU Club activities, the undersigned acknowledges, appreciates, and agrees that:

1. Participation includes possible exposure to and illness from infectious disease including, but not limited to, MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest club official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the Metro All-Stars AAU Club, their officers, officials, agents, coaches, and/or volunteers, employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (RELEASEES), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I/WE HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I/WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
