***** Covid/Injury RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT - Required reading for coaches, fans, players, parents, etc. *****

RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

In consideration of, and as a pre-condition to, player/registrant being allowed to participate in the Motor City Classic Baseball Tournament (hereinafter referred to as "MCC") he/she (or if a minor, his/her parent(s)) hereby:

1. ACKNOWLEDGE(S), agree(s) and represent(s) that the above-named player/registrant has received or had the opportunity to receive a physical examination by a qualified physician prior to participating in any baseball activity. He/she/they hereby consent(s) (but do(es) not require Michigan Jets 18U, Inc. (Organization) d/b/a the Motor City Classic Baseball Tournament) to have an athletic trainer and/or doctor of medicine or dentistry (if applicable) provide said player/registrant with medical assistance and/or treatment in an emergency and agree(s) to be responsible not only for the choice and timing, but also financially, for the cost of such assistance and/or treatment.

2. FULLY UNDERSTAND(S) that a) participating in baseball and other sports, as well as merely being present at the various tournament locations, involves risks and dangers of serious and/or non-serious bodily injury, including but not limited to acquiring viruses (such as Covid19/Corona Virus), other diseases, non permanent or permanent disability, paralysis and/or death ("Risks"); b) these Risks and dangers may be caused by the player/registrant's actions or inactions, the actions or inactions of others participating in the tournament or otherwise at the location, the condition of the equipment, any team activities, the condition of the fields and related structures, grounds, parking lots, buildings and fences and/or the negligence of the "Releasees" named below; and c) there may be other risks and social economic losses either not known to me or not readily foreseeable at this time. The player/registrant (or if a minor, his/her parent(s)) hereby accept(s) and assume(s) all such risks and all responsibility for the damages, costs and attorney fees related thereto.

3. HEREBY RELEASE(S), discharge(s), hold(s) harmless and covenants not to sue the MCC organization, its owners, principals, officers, directors, coaches, recruiters independent contractors and/or managers involved with the company, their affiliates and/or their respective administrators, directors, agents, officers, members, volunteers and employees, sponsors, advertisers and, if applicable, owner(s) and lessor(s) of the premises (each considered one of the Releasees herein) from/for any and all liability, claims, demands, losses or damages on the player/registrant's account caused or alleged to be caused in whole or in part by the negligence or other actions (or failure to act) of the Releasee(s) or otherwise, including but not limited to negligent rescue operations and/or lack of rescue. The player/registrant (or if a minor, his/her parent(s)) further agree(s) that if, despite this Release, Waiver of Liability, Assumption of Risk and Indemnity Agreement the player/registrant (or if a minor, his/her parent(s)), or anyone on the player/registrant's behalf, makes a claim against any of the Releasees, the player/registrant (or if a minor, his/her parent(s)) will completely and unconditionally indemnify and save and hold harmless, each of the Releasees from any and all litigation expenses, attorney fees, losses, liabilities, damages or costs which they may incur as a result of such claim(s).

4. AUTHORIZES, MCC to take the player/registrant's picture, to the extent necessary for tournament registrations and/or advertising purposes.

5. HAVE READ THIS AGREEMENT, FULLY UNDERSTAND(S) ITS TERMS , UNDERSTAND(S) THAT IT IS INTENDED TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
