WAIVER & RELEASE
Physical exercise can be strenuous and subject of serious injury. The Jupiter Senior Softball Association (JSSA) urges all individuals to obtain a physical examination from a doctor before participating in any JSSA activities.

I voluntarily, and of my own free will, elect to participate in JSSA activities. I understand that there are certain risks involved in participation that may result in injury as a result of weather, playing conditions, equipment and other participants. I agree that if I engage in a physical exercise or activity, I do so entirely at my own risk. I agree that I am voluntarily participating in these activities and assume all risk of injury, illness, or death. I am in good health and have no physical conditions that would prevent me from participating in JSSA activities.

I acknowledge that I have carefully read this Waiver and Release and fully understand that it is a release of liability. I expressly agree to release and hold harmless JSSA, including members of the Association, Directors, Managers, Players, Sponsors, the Town of Jupiter or its employees from any and all liability for any harm, personal injury, property damage, illness, including but not limited to COVID-19, or other damage resulting from participation in JSSA activities, including all risk, whether foreseen or unforeseen.

I will indemnify and hold harmless JSSA, including members of the Association, Directors, Managers, Players, Sponsors, the Town of Jupiter or its employees from any loss or liability including but not limited to bodily injuries, illness, death, and/or for damage to property, including the loss of use thereof, which results or is alleged to have resulted from my participation in JSSA activities.

To the extent that statute or case law does not prohibit release of negligence, this release shall include, but not be limited to, a claim for negligence, fault, neglect, or otherwise of JSSA. This release is binding upon me, my heirs, executors, administrators, and assigns.

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

By signing this release, I acknowledge and I understand its content and that this release cannot be modified orally.
