With R1 on 2B, R2 on 1B, B3 hits a fly ball to RF. F9 and F8 collide and the ball is on the ground. The plate umpire in a one-umpire system hesitates and delays a call until seeing F9 retrieve the ball and return it to the infield. Time is called with runners on 3B and 2B. The defense notifies the umpire that B3 is on 3B. In (a) before a pitch, legal or illegal, has been committed, or (b) after a pitch, legal or illegal, has been committed.

In A, wouldn't B3 be out?

In A as b3 has passed r2 then b3 would be out as per passing the proceeding runner rule. In B the the play would be allowed to continue as the violation had not been acted upon before the next legal or illegal pitch took place.
Also would like to note that this should have been observed and ruled on by the umpire as soon as it happened and not wait for an appeal to take place. In FED if a runner is obstructed and a runner passes the preceeding obstructed runner then the runner would not be be out, just something to ponder.

RULING: In (a) B3 is out for passing a preceding runner. In (b) all play is legal after a pitch.
Rule 8 Section 7D. Rule 10 Section 3C.
